A judge recently told the state it was illegally collecting increased property taxes. Too bad the money is already being spent!

More on that in a moment on the Face The State Radio Minute.

You’ve probably heard by now about the landmark decision by Denver District Judge Christina Habas, who found the state’s property tax hike which went into effect this year to be unconstitutional. Her logic is pretty simple: The state constitution requires the government to ask first before instituting any policy which results in a higher taxes.

That’s just what legislative Democrats, along with Governor Bill Ritter, did last year in the innocently named “Colorado Children’s Amendment.” They should have called it the “Stealing more of your money Act.”

Ritter is now crying to any reporter who will listen about the plagues and pestilence which will besiege Colorado’s schools if they go without the over $100 million that’s already been collected and spent.

This could have all been avoided. If only lawmakers had asked first, before soaking property owners.
